Terms of service
OVERVIEW
This website, ddtmade.com, is operated by DDT Made, a metal fabrication shop based in Converse, Texas. In these Terms, "we", "us" and "our" mean DDT Made, and "you" means anyone who visits the site or buys from us. By browsing the site, placing an order, or using any tool or content on it (the "Service"), you agree to these Terms of Service and to the policies they refer to: our Return Policy, Fulfillment Policy, Warranty Policy and Privacy Policy. If you don't agree, please don't use the Service. Any new features or products added to the site are also covered by these Terms. The current version is always available on this page. Our store runs on Shopify, which provides the platform we use to sell to you.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms, you confirm that you are at least the age of majority where you live, or that you are the age of majority and have given permission for a minor in your household to use the site. You may not use our products or the Service for any illegal or unauthorized purpose, or break any law where you live (including copyright law) while using it. You may not upload viruses or any other harmful code. Breaking any of these Terms may lead to your access being terminated immediately.
SECTION 2 - GENERAL CONDITIONS
We can refuse service to anyone, for any lawful reason, at any time. Payment card details are always encrypted when they are sent over the internet. Other content you send us may pass through various networks and be adjusted to fit different devices. You agree not to copy, reproduce, sell, resell, or exploit any part of the Service, its content, or our designs without our written permission. Section headings in these Terms are for convenience only and don't change their meaning.
SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We work hard to keep the information on this site accurate, but we can't guarantee it is always complete or current. It's provided for general information and shouldn't be the only basis for a decision. The site may include older content kept for reference. We may update content at any time but aren't obliged to, and it's your responsibility to check for changes.
SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices are in US dollars and can change without notice. We may change, suspend, or discontinue any part of the Service or any product at any time. We aren't liable to you or anyone else for any price change, suspension, or discontinuation.
SECTION 5 - PRODUCTS AND SERVICES
- Handmade variation. Our pieces are cut from steel on a CNC plasma table and finished by hand. Small differences in finish, texture, color and size between a piece and its photos are a normal part of handmade work and are not defects. Colors can also look different depending on your screen.
- Personalized and custom orders. You are responsible for checking the names, initials, dates, spelling and any other details you provide. We cut exactly what you submit. Personalized and made-to-order pieces are covered by our Return Policy, which explains when they can and can't be returned.
- Raw steel and outdoor use. Raw or unsealed steel will rust and develop a patina over time, especially outdoors. That is expected and isn't covered as a defect. See our Warranty Policy for details.
- Fire pits and DIY kits. Fire pits get extremely hot and should only be used outdoors, on a non-flammable surface, under adult supervision and following local fire rules. Cut steel and DIY kit parts can have sharp edges, so wear gloves and keep them away from young children. You use and assemble these products at your own risk.
- Digital files (DXF / SVG). When you buy a digital file, you receive a non-exclusive, non-transferable license to use it to cut pieces. You may sell the physical pieces you cut from our files. You may not resell, share, give away, or upload the files themselves, whether original or modified. All designs remain the property of DDT Made. Digital files can't be returned once delivered.
- Availability. Some products are made in limited quantities or only available online. We may limit quantities, limit sales to certain people or regions, or discontinue any product at any time. We don't guarantee that our products will meet every expectation, or that any errors in the Service will be corrected.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We can refuse or cancel any order, or limit the quantity bought per person, household or order. That includes orders placed by or under the same customer account, payment method, or billing or shipping address. If we change or cancel your order, we'll try to let you know using the email, billing address or phone number you gave us, and any payment will be refunded. We may also limit or decline orders that appear to be placed by resellers or for fraudulent purposes. You agree to give current, complete and accurate purchase and account information, and to update it promptly, including your email address, payment details and shipping address, so we can complete your order and contact you.
SECTION 7 - OPTIONAL TOOLS
We may give you access to tools from third parties that we don't monitor or control. They are provided "as is", without warranties of any kind, and we aren't responsible for your use of them. Using them is at your own risk, under the terms of whoever provides them. New tools or features added to the site are also covered by these Terms.
SECTION 8 - THIRD-PARTY LINKS
The site may link to other websites, such as social media, payment providers and shipping carriers. We aren't responsible for their content, accuracy, products or practices, or for any harm related to them. Please review a third party's own policies before using their site or buying from them.
SECTION 9 - CUSTOMER SUBMISSIONS, ARTWORK AND FEEDBACK
- Custom artwork. When you send us names, logos, photos or designs for a custom piece, you confirm that you own them or have permission to use them, and that they don't infringe anyone's rights or break any law. You give us permission to use them to design, quote and make your order. We may decline requests involving content we believe is offensive, unlawful, or infringes someone else's rights.
- Ideas and feedback. Any ideas, suggestions or feedback you send us may be used by us without restriction or payment to you.
- Your content. You agree that your comments, reviews and messages won't violate anyone's rights, contain unlawful or abusive material, or include malware. You're responsible for what you submit. We may, but aren't required to, remove content we find objectionable.
SECTION 10 - PERSONAL INFORMATION
Personal information you submit through the store is handled under our Privacy Policy.
SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS
The site may occasionally contain typographical errors, inaccuracies or omissions in product descriptions, pricing, promotions, shipping charges, delivery times or availability. We may correct them, and change or cancel orders affected by them, at any time without prior notice, including after you've placed your order. We aren't obliged to update information except as required by law.
SECTION 12 - PROHIBITED USES
In addition to the other restrictions in these Terms, you may not use the site or its content:
- for any unlawful purpose, or to encourage others to break the law;
- to infringe our intellectual property or anyone else's, including copying or redistributing our designs and digital files;
- to harass, abuse, defame or discriminate against anyone;
- to submit false or misleading information;
- to upload viruses or other malicious code;
- to collect other people's personal information, or for spam, phishing or scraping;
- to interfere with or get around the security features of the site.
We may end your use of the Service for breaking any of these rules.
SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We don't promise that the site will be uninterrupted, timely, secure or error-free. Apart from the express warranty in our Warranty Policy, the Service and our products are provided "as is" and "as available", without other warranties of any kind, to the fullest extent permitted by law. That includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, DDT Made, its owners, employees and suppliers are not liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Service or any product, including lost profits or data. Our total liability for any claim is limited to the amount you paid for the product involved. Some states don't allow certain of these limitations, so they may not all apply to you. Nothing in these Terms limits rights you have under consumer protection law.
SECTION 14 - INDEMNIFICATION
You agree to defend, indemnify and hold harmless DDT Made and its owners, employees and suppliers from any claim or demand, including reasonable attorneys' fees, made by a third party because of your breach of these Terms, your violation of any law or third-party right, or artwork or content you provide to us.
SECTION 15 - SEVERABILITY
If any part of these Terms is found to be unlawful or unenforceable, that part will be enforced to the fullest extent allowed, or removed, and the rest of the Terms stay in effect.
SECTION 16 - TERMINATION
Obligations you took on before termination still apply afterwards. These Terms remain in effect until either of us ends them. You can end them at any time by telling us or by no longer using the site. If we believe you have broken these Terms, we may end them without notice. You'll still owe any amounts due up to that date, and we may refuse you access to the Service.
SECTION 17 - ENTIRE AGREEMENT
These Terms, together with any policies posted on this site, are the entire agreement between you and DDT Made about the Service. They replace any earlier agreements or communications. If we don't enforce any part of these Terms, that doesn't waive our right to do so later. Any unclear wording won't be interpreted against us as the author.
SECTION 18 - GOVERNING LAW
These Terms, and any separate agreements under which we provide products or services, are governed by the laws of the State of Texas and of the United States. Any dispute will be handled in the state or federal courts located in Bexar County, Texas.
SECTION 19 - CHANGES TO TERMS OF SERVICE
You can review the latest version of these Terms at any time on this page. We may update, change or replace any part of them by posting updates here, and it's your responsibility to check for changes. Continuing to use the site after changes are posted means you accept them.
